摘　　要：什么是财产?财产是一种社会/法律的解释。财产在所有的基本权利中是表现最为显著的一种创造状态。婚姻法中理解作为夫妻财产的"财产"时,应从婚姻财产法律制度的价值取向出发,去认识财产的意涵。文凭、执照等作为重要的人力资本,已成为现代婚姻关系中越来越重要的财富。文凭、执照等财产的属性决定了,在界定夫妻共同财产的范围时,必须考量其应有价值。What is property? Property is just one construction of social life,which shows a mode of most great creation.In marriage,one should comprehend the system of marital property from the value of law,then catch the property's implication.As significant human capitals,diploma & license have been become more and more important in marriage.The property characterization of diploma & license make the necessity of taking into consideration of including them to be marital property.
