引发农村土地冲突的土地法规缺陷浅析

摘　　要：浅析了由于征地制度缺陷、农地所有权模糊、农地承包权残缺、土地矛盾调解制度缺陷等土地法规缺陷所引起的农村土地冲突。土地法规缺陷引起的各个土地权益主体非合作倾向或机会主义行为,使土地冲突在所难免。通过对相关引发土地冲突的土地法规缺陷的浅析,为国家完善土地法规提供可靠的理论依据。This paper discussed the rural land conflicts caused by the defects in the laws related to land, such as the defects of land purchasing system, the agricultural land ownership vague, and the defects of land conflict mediation system. These defects stimulate each owner of the land, as an individual, to grow the intention of non--cooperation or to conduct opportunistic behavior, which makes the land conflict inevitable. A theoretical basis for improving the land related laws is concluded through the analysis of the defects of the land related laws which intrigue the land related conflicts.
