地理标志农产品标准化之法律经济分析

摘　　要：地理标志体现着产品在其历史过程中积淀的宝贵的无形资产,在某种程度上属于特定地域的"公共资源"。从经济学理论来看,地理标志属于俱乐部产品,其使用中面临着"搭便车"问题、"公地的悲剧"或"囚徒困境",因此,必须加强监管。对地理标志农产品而言,标准的制定和实施成为保证地理标志农产品质量、防止滥用并危害地理标志农产品声誉的重要路径。地理标志农产品标准从层次上可以分种植(生产、养殖)技术规范、地方标准、国家标准。制定和实施地理标志农产品标准可以促进农业标准化和农业产业化的发展。地方政府应制定和实施农产品地理标志战略,促进地理标志的申报、使用、管理和地理标志农产品标准化。Geographical indications embodies the intangibles accumulated in the history, and it＇s a kind of public resources for specific area to some extent. Geographical indication is club products from the angle of economics theory,and in the utilization,it usually faces the problems of ＂free-riding behavior＂,＂the tragedy of public glebe＂, or ＂the prisoners dilemma＂, so that it＇s absolutely necessary to strengthen supervision in the use of geographical indications. For agricultural products with geographical indications, the formulation and implementation of standards is an important approach to guaranteei the quality, to prevent the abuse of geographical indications and then damage the reputation of the products. The standards of agricultural products with geographical indications can be divided to Planting specifications, local standards and national standards. The formulation and implementation of standards on agricultural products with geographical indications will promote the agricultural standardization and the agricultural industrialization. Local governments should work hard to make implement strategies on agricultural products with geographical indications, and also promote the declaration, use, and management of geographical indications and the standardization of agricultural products with geographical indications.
