《城乡规划法》实施评估及政策建议--以西部地区为例

摘　　要：采用问卷调查、专家访谈、地方调研和文献分析等方法,对我国西部地区《城乡规划法》实施情况进行了评估。研究发现,西部地区在《城乡规划法》的学习宣传、地方立法、行政体制调整和管理制度建设等方面已取得重要成就,但存在政府行政管理交叉、法律实施保障不足、部分条文存在争议和操作困难、地方立法混乱及社会法制意识薄弱等突出问题,制约法律的有效实施。研究认为,应尽快出台法律实施细则等相关配套法律法规和技术规范,完善城乡规划法律法规体系;加强法律监督,维护法律的权威性;关注西部地区的特殊性,制定适合西部区情的城乡规划政策指引;继续加强法律宣传教育和学习培训,促使法律精神的社会内化。The study evaluated the implementation of＂ Urban and Rural Planning Act＂ in the western region of China, through questionnaires, interviews, site visit, literature analysis and so on. As found, great progress of study and publicity, local legislation, administrative system adjustment and management system setting etc. has been achieved. However, problems of cross-government administration, inadequate implementation measures, some disputed provisions and operational difficulties, local legislative confusion and poor legal awareness etc. are still notable, which restricts the effective implementation of the Act. It concludes with suggestions as following： legalize the detailed implementation rules and regulations, as well as other related regulations and technical standards, as soon as possible, in order to improve the system of urban and rural planning laws and regulations; strengthen legal supervision to maintain the authority of the law; pay attention to the specific conditions of the western region to formulate the proper urban and rural planning policy guidances; continue to strengthen the publicity, education and training of the law to promote the awareness of the law in the society.
