摘　　要：近年来,我国学术不端现象不断滋生蔓延,不仅破坏了我国的科研环境和科研人员的整体形象,而且也影响了创新型国家的建设。虽然国家有关部门和科研机构近年来制定了防治学术不端行为的部门规章和相关处理办法,但是,这些规章或办法并没有达到其应有的防治效果,学术不端现象仍屡禁不绝。为此,有必要从行政法律的角度强化对学术不端行为的规制,实现学术道德和学术法治的双重规制。In recent years,the phenomenon of academic misconduct continues to spread in our country,which not only undermines the research environment and the overall image of research personnel,but also affects building of innovative country.Although the relative state departments and research institutions design departmental rules and regulations of academic misconduct in recent years,however,these regulations or approaches do not achieve their desired control effect.The phenomenon of academic misconduct remains despite repeated prohibitions.Thus,it is necessary from the perspective of administrative law to strengthen the regulation of academic misconduct,to achieve academic dual regulation ethics and academic rule by law.
