摘　　要：文章从国有控股、参股公司中的经济犯罪查办实践出发,对刑法意义下国有公司范畴以及国有控股、参股公司中国家工作人员身份的认定做进一步明晰,对国有控股、参股公司中国家工作人员职务经济犯罪问题游离于刑事司法之外的状况进行分析,并提出对策。The article through the practice of investigating the economic crimes of state-owned holding,joint-stock companies,makes further clarity of identification of the identity of national staff in state-owned companies in accordance with criminal and state-owned holding,joint-stock companies,analyzes the situation of official economic crimes of national staff in state-owned holding,joint-stock companies separated outside the criminal justice,and then provides countermeasure.
