民族平等的实质内涵与政策限度

摘　　要：采取特别保护政策协调与处理民族关系问题,是我国落实民族平等理念的基本手段。通过实施特别保护政策保障群体权利的实现,消除特定区域或特定群体的公民权利实现的现实制约因素,促进具有不同民族身份的公民真正拥有平等的法律权利,是落实民族平等的根本目的。在实践中,针对特定的群体在经济、文化、社会方面与其他群体存在的事实差异,根据理性、合理和正当的决定,采取某些适当的、合理的、必要的区别对待的政策措施,其根本意义在于为公民提供平等发展的条件,实现实质上的平等。针对实践中一些群体性的特别措施需要与作为特定群体的个体的结合才能得以实施的问题,在制度设计与实施中尤其需要重视群体性政策措施的合理限度问题,防止群体性的特别措施异化为个体特权。此外也应防止通过赋予少数民族群体权利以消解制约其成员实现个体权利的限制因素的政策措施对其内部成员个体权利的侵犯。a basic approach for implementing the idea of national equality is to take special protective measures to coordinate and handle national relationship issues. The fundamental purpose for implementing national equality is to take special protective policies guaranteeing realization of rights of groups, eliminating practical factors restricting realization of citizen＇s rights of special groups or in specific area, and promoting citizens of different nationalities to have equal legal rights. In practice, according to the actual difference between specific groups and other groups in terms economy, culture and society, based on rational, reasonable and justified decisions, some appropriate, rational and necessary distinguishing policies and measures, and the fundamental significance is to provide condition for equal development for citizens to realize substantial equality. For some issues that can not be carried out until some special group-oriented measures are combined with individuals in specific group, the issue of reasonable limit for group-oriented policies and measures must be paid attention to in designing and implementing the systems to prevent the group-oriented special measured changing to individual privilege. Besides, it also should be avoided to infringe upon its internal individual＇s rights through giving group rights of national minorities to mitigate policies and measures of factors restricting its members to realize individual rights.
