摘　　要：刑罚的根据就是刑罚的正当性。报应论、功利论,以及基于报应论和功利论的各种一体论,都不是刑罚的完整的、科学的根据。报应论和功利论失之片面。一体论以报应论和功利论的二分为前提,实质上是二元论。一体二性论把刑罚的根据看作一个整体,把刑罚的报应性和功利性看作这一整体的二重属性,其中,报应性是其本质属性,功利性是其自然属性和价值属性。The justification of punishment is one of the most fundamental problems in penal theories. None of the theory of retribution, the theory of utility, and the theories of integration could serve as the complete and scientific justification of punishment. The theory of retribution and the theory of utility are one-sided and the theories of integration are in nature dualism. In this paper, the justification of punishment is regarded as one body with retribution and utility as its two attributes, with retribtttion being the essential attribute and utility being the natural and value attribute.
