摘　　要：业主区分所有之共用部分是住宅小区共有权结构中另一"物法性"要素,界定业主区分所有之共用部分所有权的性质、归属,厘清共有权的内容,探究所有权和专用使用权的法律性质,进一步研究住宅小区其他相关法律问题,提供一种新的思路。The common part enjoyed by owners with partitioned ownership is one factor in the structure of the co-ownership rights in residential areas.In order to further study other relevant issues in residential areas,a new perspective is suggested to define the nature and attribution of common parts ownership with owner's partitioned ownership,to specify the content of co-ownership,and to explore legal nature of ownership and right to exclusive use.
