治安管理处罚担保制度之我见——兼与赵化勤、朱凤清商榷

摘　　要：从法律价值、适用范围和法律属性上来看,治安管理处罚担保制度仅适用于行政拘留的暂缓执行,不能随意扩大到罚款处罚以使“暂扣款”合法化。Viewing from the legal value,applying scope and legal properties,the guarantee system of public security administration punishment can merely be applied to the suspension of administrative detention but not be extended arbitrarily to the punishment of fine which may make the guarantee payment become legal.
