摘 要:对于交通限行措施,可以选择单双号限行这一典型性样本加以行政法维度之解读。首先,鉴于单双号限行措施的刚性色彩,在交通行政治理中应注重新型行政手段的柔性引导,刚柔并济。其次,在单双号限行背后的"公共利益——个人利益"的关系结构中,公共利益代表者基于个人利益主体的利益让渡而给予补偿,这其中的利益博弈应体现比例原则之精神。最后,单双号限行措施总体上符合形式合法的底线要求,其后续的"政策补丁"体现了对实质合法的追求和合法性的补强。As for traffic limitation methods, the even-odd traffic regulation can be taken as a typical sample for interpretation from the aspect of administrative law. Firstly, since the regulation is too finn, flexible guidance should be introduced in to new administrative method. Secondly, as the public interest and benefit behind the regulation is based on the delivery of personal one, the spirit of proportionality principle should be embodied in the compensation. Thirdly, since the regulation meets only the lowest demand of formal legality, the subsequent supplementation policies should incarnate the pursuit for substantive legality and the reinforcement of legality
