摘　　要：利益平衡是法的基本价值判断标准,在正义、秩序等法的基本价值的指导下,利益平衡在社会资源配置过程中对利益选择起着导向作用。知识产权领域中也存在个人利益与公共利益的之间的冲突,利益平衡同样发挥着协调作用,并通过多种制度形式表现出来。The principle of balance of interests is the basic judgment standard of the value of law which plays a guiding role in the process of allocation of the social materials and resources. In the field of intellectual property there still exist the conflict between personal interests and public interests, so the principle of balance of interests also plays a coordinated role and is embodied by diversified forms.
