摘　　要：人体器官移植技术被誉为"21世纪医学之巅",它的应用使得人类医学科学的发展有了革命性变化。随着2007年《人体器官移植条例》的出台,中国器官移植法律制度已基本成型。不可否认的是,该条例在诸多方面缺乏细致规定,对诸如脑死亡、器官移植协调机制、补偿措施等敏感问题的规定仍属空白。该文评析了中国人体器官移植立法存在的问题,并就完善中国器官移植立法提出了建议。Human organ transplant technology,known as ＂the most advanced technology in the medical world in the 21st century ＂,has brought an innovative change in the development of human medical science.As the Human Organ Transplant Ordinance was published in 2007,our legal system for organ transplantation has basically formed.However;we have to admit that this ordinance lacks detailed provisions in some aspects.Areas concerning certain sensitive issues such as brain death,organ transplant coordination mechanism and compensation measures have still remained blanked.This paper analyzes and discusses the existing challenges in our legal system of organ transplantation,and then puts forward relevant suggestions to further improve it.
