低碳经济下的电子送达方式正当性研究

摘　　要：电子送达是利用网络等先进技术将法律文书送达给当事人及其他诉讼参与人的一种送达方式。它具有技术先进、司法资源消耗低、节约、环保、送达周期短、高效及充分保障当事人及其他诉讼参与人的合法权益的价值,使法院工作能够有效运转,完全符合低碳社会下的低碳消费、低碳理念、高科技、人与自然及人与人的社会和谐的发展要求,具有正当性。The electronic service is a kind of services that makes use of the network technology to send legal documents to the parties and other participants. It is valuable in terms of the advanced technology, low judicial resources consumption, economy, environmental protection, instant delivery, high efficiency and fully securing the legitimate fights and interests of the parties and other litigant participants. The electronic service enables the courts to operate effectively, and completely accords with the development requirements of low - carbon consumption, low - carbon ideas, high technology, and social harmony between human beings and human beings, between human beings and nature, which is reasonable.
