摘　　要：农村土地资源是农民赖以生存的物质保障。近年来因土地问题引发的纠纷已对农业生产的安全和农村社会的稳定产生消极影响。妥善处理农村土地流转纠纷已经成为保障农村稳定的关键之所在。在现实的司法实践中,目前我省土地流转纠纷主要有土地承包合同纠纷,土地承包经营权侵权纠纷,土地承包经营权流转纠纷、土地承包权继承纠纷四种类型。呈现出纠纷数量大,递增明显,涉及人数多的特点。存在这些问题的原因为立法的滞后与过分概括及司法的低位与窘境。这些问题的解决有赖于法律的细化与重构,承包经营机制的完善与相应配套机制的建立以及建立土地承包日常管理机制。Rural land resource is the material guarantee for the survival of farmers.In recent years,land disputes have a negative impact on agricultural production and social stability in rural areas.Properly handling the transfer of rural land has become a security key to keep stability.In judicial practice,land transfer contract disputes,land contract and management rights infringement,the right to transfer land contract and management disputes,inheritance disputes,land contract rights are four types.The reasons for these problems are to refine and resonstruct the legal system,improve appropriate supporting mechanism and establish the mechanism of the daily management of the land contract.
