国有农地承包纠纷的法律适用

摘　　要：除了直接交由农民集体使用的国有农地之外,其他由国有农场享有使用权的国有农地在承包给农户、个人或其他单位经营的过程中产生的纠纷,应当"参照"而非"严格"适用《农村土地承包法》和《物权法》。在国有农场土地承包纠纷领域,应适当平衡国有农场的企业经营自主权与土地承包方的土地承包经营权。国有农场土地承包经营关系中对承包经营权的保护程度,应当根据作为发包方的国有农场不同的发展方向、不同的企业管理需求和对承包方的不同保障程度而进行适度调整。Except the state-owned agricultural land which is exploited by agricultural economic collectives,when concerned about the contracting disputes on other state-owned agricultural land which is used by state-owned farm,Law on the Contracting of Rural Land and Property Law should be ＂referred to＂ but not to be ＂strictly applied＂.In the contracting disputes on state-owned farms,there are conflicts between the managerial autonomy of state-owned enterprises and the contract-undertaking party＇s right to operate contracted landing.The level of protection for rights of operating contracted landing of state-owned farm should be reasonably adjusted according to different developmental direction of the state-owned farms,their different business managerial requirements,and their different levels of social security for the contract-undertaking parties.
