摘　　要：如何界定婚姻关系的本质,法学界众说纷纭。其实透过现象看本质就可清晰地感受到:婚姻关系既具有身份性和伦理性,又有财产性和契约性,它是社会综合系统之一。最高人民法院关于适用《中华人民共和国婚姻法》若干问题的解释(三)便是对婚姻关系的现实反映。其在规制婚姻领域的人身关系和财产关系的同时,适时弥补了婚姻立法的不足,彰显了婚姻领域的人格独立与人格自由。There are different ideas about the inner character of marital relation in legal areas. You can get it if you investigate from the appearance: Marital relation occupies not only personality but also the ethical character. It is one of the complicated social systems. The Supreme People’s Court offers a realistic reflection about marital relationship in the Judicial Interpretation Of The Marriage Law (Ⅲ) Of the People’s Republic Of China,which in time makes up the deficiency of our marriage legislation while regulating both the personality relationship and the property relationship,especially demonstrating the independent personality and freedom.
