摘　　要：以宁夏等11省(区、市)的土地承包经营权抵押实践为研究对象,归纳现阶段实践中借贷双方、抵押标的以及抵押贷款"模式"等方面的主要特征,并用案例研究方法深入剖析宁夏同心县土地经营权抵押贷款试验的实质:农户以土地经营权为抵押反担保获得土地协会保证担保后向信用社贷款;对信用社和贷款农户而言,不是农户土地承包经营权这一"物"的抵押(担保)贷款,而是以土地协会和其他农户为保证人的保证(担保)贷款。在讨论土地承包经营权抵押贷款时应在清晰界定其概念基础上,区分不同方式、不同抵押标的。By analyzing the practice of the mortgage loan of land contractual operation right in 11 provinces, this paper concludes the main traits in debtor and creditor, mortgage target, and mortgage mode. We investigate into the test in Tongxin county in Ningxia province.The essence of the mortgage loan of land contractual operation right is that farmers get loan from rural credit cooperative with land association＇s surety guarantee which base on mortgage counter guarantee with farmer＇s land management right. To rural credit cooperative and loaning farmer, it is guarantee loan with the land association and other farmer＇s surety, but not with the mortgage of farmer＇s land contractual operation right. As discussing the mortgage loan of land contractual operation right, three basic problems should be distinguished.
