摘　　要："法律与文学"运动是20世纪70年代滥觞于美国继而在中国兴起的一种学术运动,"文学中的法律"是"法律与文学"运动最重要的分支。"文学中的法律"以文学文本作为样本或者平台来探究其中所蕴含的法律问题,这就在研究者与社会现实之间设置了一个"媒介"(文学作品),"发现作品"和"解读作品"就成为研究者必经的两个环节。"文学中的法律"的研究对弘扬法的价值、普及法的知识、改进法学教学、加强法律修辞具有积极的作用。An academic movement known as ＂the law and literature movement＂ originated in the 1970s in the United States and then arose in China. As one of the most important branches of ＂the law and literature movement＂ , ＂law in literature＂ tries to probe into the law issues based on the samples or platform provided by literary output, which creates a media （liter- ature） between the researchers and social reality. The research on ＂law in literature＂ plays a positive role in boosting the value of law, popularizing the basic knowledge of law, improving law teaching and strengthening the legal rhetoric.
