摘　　要：财富的一半是契约,契约效力来源的探讨不仅关系到契约法体系的完善,更与未来的立法走向关系重大。对契约的尊重,可以彰显法治社会的人文关怀,防止公权力的肆意践踏。从某种程度上说,对私人合意的尊重,是市民社会与政治国家相互博弈的结果,任重而道远。Contract stands for a half of wealth. It is the essence of contract that not only relates to improvement of contract system, but also closely to the legislation in future. Respect for contracts demonstrates the humanistic concern to people, preventing wanton intervention of public power. To a certain degree, respecting for the private agreements not only results from the coordination between civil society and political country, but also has rich meaning.
