复制权例外对图书馆数字资源长期保存的影响剖析

摘　　要：选取英国、美国和澳大利亚当前的数字资源长期保存活动为分析案例,研究这三个国家可适用于图书馆的著作权例外在图书馆数字资源长期保存方面的应用,剖析其存在的不协调性。指出数字资源的长期保存由于以下原因更需要图书馆享有合理的复制权例外:数字资源的保存需要多份复制件;数字资源长期保存中出现的软硬件老化;难以预见的老化;数字资源的生命周期与虚拟传播;数字资源保存需要建立一种动态的管理机制;数字资源长期保存需要采取联盟的方式实施。The paper explores the application and lag of exceptions of duplication right applicable to library community in digital resource long-term preservation in UK, US, as well as Australia. On that basis, the author points out that the characteristics of digital resource long-term preservation in library world urgently need adequate exceptions of duplication right, according to that ：① More copies are needed; ②Software and hardware become aging; ③There is unpredictable aging; ④There is bit-stream communication; ⑤It needs a dynamical management mechanism; ⑥Alliance system can be fitter for digital resource long-term preservation.
