体育赛事违约责任中的精神损害赔偿研究——从“假球”、“黑哨”看球迷的权利保护

摘　　要：以我国足球职业联赛中出现的"假球"、"黑哨"事件为切入点,从赛事组织者与持票观看赛事表演的球迷之间存在的法律关系出发,讨论现场观众的权利保护问题。按照以下逻辑顺序展开:体育赛事观看服务合同概述,体育赛事观看服务合同的本质要求与合同根本违约,现场观众基于合同违约请求精神损害赔偿的法理分析、法制保障分析以及严格限制适用条件,建议在这种订立合同以精神享受为目的,确认参赛方违反诚实信用原则即确认存在"假球"或"黑哨",现场观众情绪极为波动的特殊情况下,应当给予现场观众以精神损害赔偿。From the legal relationship between the event organizers and fans watching events show , taking ＂fixing＂, ＂ black whistle＂ event happening in Football Leagued as the starting point ,the article discuss the rights of the fans on - site protection. This paper starts as follows： characteristics and the concept of sports events watching service contracts; essential requirement and fundamental breach of sports events watching service contracts; the legal analysis of spirit damages ,legal protection and strict restrictions apply conditions based on the request of the audience . Under the special condition that take ertjoying the spirit as the purpose ; confirm entries violating the principle of good faith , that is, existing ＂fixing＂ or ＂black whistle＂, the audience should be given to Mental Damage.
