社会矛盾化解下的公安执法理念研究

摘　　要：理性、平和、文明、规范执法是公安民警的执法新理念,社会矛盾化解是对公安民警执法的新要求,二者相辅相成,目标一致。理性、平和、文明、规范执法中蕴含着社会矛盾化解,社会矛盾化解是理性、平和、文明、规范执法的核心。公安民警在执法中应坚持理性执法为先导的原则,处理好理性执法与严格执法的关系;坚持宽严相济的原则,处理好宽严相济与严厉打击的关系;坚持法律效果与社会效果并重的原则,处理好法律与民众情感的关系;坚持执法公开的原则,处理好执法公开与保守工作秘密的关系;坚持谨慎执法的原则,处理好谨慎执法与工作创新的关系。To enforce law in rational,gentle,civilized and standardized way is a new principle for public security police,and to resolve social contradictions is a new requirement for their enforcement of law;they complement each other under the same objectives,because the former embodies the latter,while the latter serves as the core of the former.When enforcing laws,the public security police must be guided by the principle of rationality,dealing well with the relationship of enforcing law rationally and strictly;they must abide by the principle of tempering justice with mercy,dealing well with the relationship of alternation of leniency with severity and ruthless punishment;they must observe the principle of valueing both legal effect and social effect,dealing well with the relationship of law and public emotions;they must enforce law openly,well handling the relationship of enforcing law openly and keeping work secrets;finally,they must follow the principle of enforcing law cautiously,reasonably,treating the relationship of enforcing law cautiously and creatively.
