摘 要:本文从规律与规则的区别入手,提出了存在性规律和建构性规律的理论视域。认为工程规律是在工程实践活动中,在理解当前工程活动所涉及的各种要素之间相关性的基础上、协调各种规律综合作用的建构性规律。它直面的是在集众多技术的某种特定工程建构中"如何做"的问题,与揭示事物本质的"是什么"的规律不同。工程活动不仅涉及"是什么",更重要的是要解决"如何是"的问题,如何合理、有效的问题。工程规律是揭示指向具体工程目标的规律群如何实现从对事物属性、关系的认识到新事物的功能设计、结构架构的建构性规律,是综合集成的规律。工程规律协调的是规则之间的联系,是关于规则的规律,规则设计和规则变动的规律,具有建构性和综合集成性。This paper puts forward the theoretical view of existential law and constructional law on the basis of distinction between law and rule, and believes engineering law is the constructional law based on the understanding and coordinating the related factors in engineering practical activities. Engineering law faces the question of "how to do" in certain projects and reveals essence of "what it is". Engineering activity not only deals with "what it is" problem, but more importantly, works with how to reasonably and effectively do it problem. The engineering law refers to the constructional law in explaining how to realize from the understanding of attribute and relation to the functional design and structure shaping in specific engineering goals. It harmonizes the connections between rules, and is the law of rules, rule ,designing and rule changing. So engineering law has the features of integration and construction.
