公私法交融与我国民办高校的治理变革

摘　　要：公私法交融是指构成公法和私法重要元素之间的交叉、汇合、互补与合作,通过基本规则的互通、根本目的互嵌和规制手段的互助等方式形成"你中有我"、"我中有你"的辩证格局。在公私法交融视野中,我国民办高校治理是在公私法交融的框架内,坚持教育公益性的原则、明确政府责任、完善法人治理结构、采取管治结合的方式实现利益相关方利益最大化的过程。从现阶段看,虽然我国民办高校治理取得了巨大成绩,但还存在教育公益性面临丧失、政府应担责任不到位、法人治理结构欠完善等方面的不足,需要进一步强化公益性、明确政府的责任和完善法人治理结构。The penetration of public law and private law is the new trend of the relation between the public law and private law.In the context of the penetration of public law and private law,the governance of the private colleges is supposed to adhere to the principle of public welfare,make the government responsibility clear,improve governance structure and enrich the governance method,thus to maximize the benefits of all concerned.Nowadays there are many problems in the private colleges governance in China,therefore we should do a lot of work as required in term of the penetration of public law and private law to improve the private colleges governance.
