摘　　要：我国高等学校教育基金会通常是由高等学校出资设立的,并且高等学校教育基金会的运作依存于高等学校,二者之间存在着非对称性的依赖关系。目前,关于高等学校教育基金会的法律和规制等仍存在不完善之处,影响了高等学校教育基金会的治理和发展。建议在健全法律制度的同时,优化高等学校及其教育基金会的组织管理结构,并建立广泛的契约机制,以保证高等学校设立教育基金会的初衷得以实现。Chinese Higher Education Foundation is usually set up and funded by institution of higher education and its operation depends on institution of higher education as well. The relationship of these two is asymmetric dependence. Imperfect laws and regulations of high education foundation restrict the development and management of higher education foundation. Therefore, we recommend to perfect the legal system, optimize the organization structure and establish a wide range of Contract mechanism, in order to ensure the original intention of higher education foundation to be accomplished.
