摘　　要：以世界主要发达国家引进海外人才的法律为参照,我国引进海外人才法律不仅在法制建设总体思路和引进外国人才行政管理宏观方面,而且在外国人在我国就业、外国专家在我国工作、外国人在我国永久居留、在华留学生4个微观方面,都存在着很多内容方面的严重问题。这些问题不仅阻碍着人才强国战略的推进,还影响海外人才在我国经济社会发展中充分发挥作用。There are big gaps between China and developed states in the law of introducing foreign talents mainly due to the incorrect understanding the position and role of introducing foreign talents.The gaps are not only in the macro areas of general thinking of legal system establishment and administration,but in the micro areas of foreigner employment,foreign expert working,foreigner permanent residence and foreign students.These gaps hinder the progress of the strategy of strengthening the China by human resource and the full playing of role of foreign talents in China＇s economic and social development.
