摘　　要：以建筑工程施工合同为例，针对建筑工程施工合同为一种特殊合同，为保护实际施工人的利益，基于合同相对性质基本理论，研讨了建设工程合同纠纷中突破相对性原则的合理性。Taking construction contract of building engineering for an example, this paper points out that construction contract of building engineering is a special contract. In order to protect the interests of the actual builders based on the basic theory of contract relativity principle, it discusses the rationality of breakthrough the relativity principle in contract disputes of building engineering.
