摘 要:对"中央缺位,地方先行"的重大行政决策权问题研究,必须厘清重大行政决策的事项范围和权限划分。地方政府重大行政决策权边界问题不仅仅是地方政府对中央政府分权多少或分权事项范围的问题,而且是关涉到我国重大行政决策权的法律属性和决策权行使的法律基础和法律属性问题。本文从重大行政决策的行政法语涵及其学理规范入手,以省市地方出台规章文本和实证经验为要件,将"行政三分权"理论展开在对重大行政决策的事项范围与权限划分边界问题上研究,归结重大行政决策的行政法之独特的法律特征和其权力必当受限的宪政本质,抑或边界即为限制。To "the central vacancy, the local first" major administrative decision - problem, we must clarify the major administrative decision - making making item scope and purview division. The local government major administrative decision - making authority boundary is not only the problem of how many item scope that the local governments separate with the central government, but also the problem connect with the legal property of the state' s major administrative decision - making authority and the legal basis and property of the decision - making authority exercise. This paper studies the contents and principles of the Administrative Law about the major administrative decision - making, and the relevant rules text made by the local governments of provinces and cities and their experiences, and studies the major administrative decision - making item scope and the authority boundary with the "Administrative Three Decentralization" theory, reveals the special legal attribute of the Administrative Law of major administrative decision - making, and its authority must be limited by the constitution, or the boundary is the limitation.
