西方国家政府绩效信息资源公共获取的法制保障及其启示

摘　　要：政府绩效信息资源公开与公共获取权利的有效保障,是监督政府及其公职人员行为、推进行政民主与法治建设、实现公共责任的关键。受信息自由传统和政治责任理念的影响,西方国家在绩效信息公众获取权利保障、绩效信息资源深度共享、绩效信息资源开发市场化等法制保障建设方面取得了卓有成效的经验。为营造和谐有序的公共秩序,应顺应政府信息公开的趋势,从而提高政府绩效信息公开程度、健全绩效信息获取机制、充分利用绩效信息资源等方面,不断夯实政府绩效信息资源公共获取的法制基础。Enforcing government performance information resources publicly in legal form and effectively protecting the rights of public access to performance information is the key point to supervise conduct of government and its public officials. And then it can promote administrative democratization and legal system construction, realize public responsibility. On the impact of information freedom tradition and the concept of political responsibility, western countries achieved fruitful experiences in construction of legal safeguard system,such as protecting the rights of public access to performance information, sharing performance information resources in depth, developing performance information resources by marketization. In order to create a harmonious and orderly public order, we should conform to the trend of public government information, continue to reinforce legal system of the public access to government performance information resources by improving the degree of public government performance information, perfecting performance information acquisi- tion mechanism, and making full use of performance information resources.
