宽严相济政策与轻轻重重政策的特征比较

摘　　要：宽严相济政策兼顾保障人权与保护社会,基于对犯罪形成与发展规律的把握,强调区别对待,宽严相济,极为注重宽严并举与宽严救济,以求最大限度地实现刑事公正与效率。而轻轻重重政策以保护社会的价值理念为主导,形成于犯罪日益严重的社会事实背景,强调宽严两极发展的思想与制度,从而轻者相对去之而重者移向中心,构成新的重重阶位的刑事公正与效率。The criminal policy of tempering justice with mercy takes into account the protection of human rights and protection of society. In order to maximize the criminal justice and efficiency, the policy, based on the rules of the formation and development of crime, emphasizes treating differently on tempering justice with mercy, and focuses on tempering justice with mercy and justified remedy. The policy of punishment in accordance with crime, formed in the social background where crimes become increasingly rampant, is oriented to the protection of social values, and emphasizes the thoughts and systems which take mercy and rigor into consideration, and consequently the minor offender may be granted forgiveness and the serious criminals can move to the center to sit on the hedge,which thereby forms a new order of criminal justice and efficiency on punishment of serious crimes.
