论不连续背书持票人的权利

摘　　要：背书不连续存在于最初不连续、中间不连续和最后不连续。背书不连续也有实质不连续与形式不连续之分。形式不连续背书仅是持票人行使票据权利的障碍,不因此否认持票人的实质性权利。背书形式不连续而实质连续的持票人应可行使完整的票据权利;背书整体不连续但具有阶段性连续的持票人虽难以行使付款请求权,但鉴于付款请求权与追索权属于各自独立、性质相异的票据权利,持票人对于在连续中断后签名票据的背书人仍可享有追索权。Discontinuous endorsement, including substantial discontinuous and discontinuous in forms exists in the beginning, middle and final of the transfer process. Discontinuous endorsement in forms means the difficulties in exercising bill rights but admits the bearer＇s substantial rights. Discontinuous in form but substantially continuous holders can exercise the complete billrights. Periodical endorsement holder, though having difficulties in exercising the right to claim payment, can enjoy the rights of resource on the endorser due to the different natures of rights of payments and resource.
