网络犯罪刑事司法管辖权探析

摘　　要：网络犯罪刑事司法管辖权涉及的不单单是一个国家的管辖,更是多个国家的管辖冲突,现有法律已经不能够解决这样的冲突。通过分析网络犯罪对传统管辖权体系的挑战,引介和分析新兴的相关管辖权理论,当前网络犯罪的刑事管辖权体系需要重构。Cyber crime involving criminal jurisdiction is not only a country＇s jurisdiction,is the jurisdiction conflict of countries,the existing laws have been unable to resolve such conflicts.By analyzing cyber crime challenges on the traditional criminal jurisdiction system,introduction and analysis of the relevant jurisdiction of the emerging crime theory,the current criminal jurisdiction system of the network needs reconstruction.
