摘 要:《吸毒检测程序规定》的正式出台弥补了实践运转的诸多不便,是与《禁毒法》相呼应的时代产物。吸毒检测程序的设置不仅为司法实践的操作提供了相应框架,而且展现了法治理念与人权保障双项并重的内在旨趣。从该程序性设计的内容来看,检测对象的筛选、实体标准的认定、第三方的监督、程序申辩、检测费用的承担、检测对象的隐私权、责任归咎与权益救济等方面都存在不尽如人意之处。厘清现有程序设计中的诸多不足,针对性地提出行之有效的对策,是契合程序设计目的并进行实践有效运转的路径选择。Matching with Prohibiting Drugs Law, the formal promulgation of Detecting Junky Procedural Rules re- solves lots of inconveniences in practice. Its intrinsic essence is to advocate ideal of rule by law and human rights and to provide procedural frame for judicial practice operation. As far as the procedural contents are concerned, there are many insufficiencies, including filter of detected objects, cognizance of substantive criterion, supervi- sion by the third part, procedural averment, payment of detecting expenses, privacy rights of detected objects, obligation imputation, and remedy of rights and interests, forward effective countermeasures agrees with the purpose etc. Clarifying these procedural objections and putting pursuit of procedure design and is a correct hath selec-tion to perfect practical manipulation.
