摘 要:按照入世所作承诺,中国的飞机租赁市场已经向外国的租赁公司全面开放。外资飞机租赁公司已经成为我国飞机租赁市场的主要出租人。中国已经签署了《开普敦公约》及其项下的《航空器议定书》。这些国际法律文件将对我国飞机租赁双方的博弈产生巨大影响。外资飞机租赁公司的垄断、中资与合资飞机租赁公司的兴起,以及中国的飞机承租人与出租方的博弈,都会因为《开普敦公约》与《航空议定书》而改变。虽然这些国际条约已于2009年6月1日对中国生效,但中国国内法律并未作出任何调整。认为,必须按照这些国际条约原则全面修改和完善国内法律。这不仅是中国的国际义务的要求,也是建立能最大限度地保护中国承租人和出租人利益的飞机租赁市场秩序的要求。According to her commitments,China's aircraft leasing market has been fully open to foreign leasing companies,which have taken the place of dominant lessors in Chinese market.China has already ratified the Cape Town Convention and the Aircraft Protocol,which will make a significant impact upon competing interests in Chinese leasing market for aircraft.The dominance of foreign leasing companies,the rising of Chinese or Sino-foreign leasing companies,and gaming between the lessor and the lessee in the aircraft leasing market will all be affected by the Cape Town Convention and the Aircraft Protocol.These instruments have become effective to China since 1 June 2009,but no change has been made to the Chinese law so far.The paper argues that it is necessary to revise and improve Chinese domestic law thoroughly for the purpose of not only meeting China's international obligations,but also establishing a market order which maximizes the best interests of Chinese lessors and lessees.
