论征地制度改革应有的价值取向及实现路径

摘　　要：既有征地制度改革的价值取向集中在提高补偿标准以"让利于民",但不能从根本上触及现行征地制度。改革和完善现行征地制度的应有价值取向在于"还权于民",应系统分阶段地创设适应公有制特殊国情下的现代农地产权激励和约束,在征地中逐步实现"同地,同权,同价"。并从显化土地财产权、创设农地发展权、赋予农地转让权和界定征收救济权等方面探讨实现"还权于民"的路径。The value orientation of the land requisition system reform now is mainly concentrated in raising compensation standard to ＂offer profits to people＂,but it can＇t touch the system fundamentally.The proper value orientation should be＂return rights to people＂ to establish incentive and commitment mechanism of modern property rights which adapt public ownership and realizes＂same land,same right,same price＂,also discusses the way through clearing the rights of land property,establishing the rights of agricultural land development,endowing the rights of farmland transfer and defining the rights of expropriation relief.
