摘　　要：目的评估上海市卢湾区卫生监督部门开展"二次加重处罚"的执法效果,并找出监管重点。方法定量研究与定性研究相结合,对上海市卢湾区2008年以来对无证经营主体开展"二次加重处罚"的情况进行分析与评估。结果 (1)不同主体类型、不同主营项目、不同街道的无证经营主体屡犯屡不同。(2)"二次加重处罚"对当事人改正违法行为具有督促作用、其效果与处罚力度、及时性和执行情况有关、并且受到其他社会、经济因素的影响。结论 (1)应将企业分支机构、美容行业、辖区南部区域作为上海市卢湾区监管无证公共场所的重点;同时应以中医行业为重点,加强对中低端商务楼无证行医的排查与监控。(2)应完善案件执行及行刑衔接机制,加强行政处罚自由裁量基准制度研究,充分体现过罚相当原则。Objective To evaluate the enforcement effects of ＂cumulative penalty for the second offense＂implemented by health supervision departments of this district and find out the supervision focuses.Methods To adopt quantitative and qualitative research methods;to analyze and assess the ＂cumulative penalty for the second offense＂,which aims at fighting against subjects without sanitation licenses.Results（1）Subjects without sanitation licenses of different entities,business projects and locations have different probabilities for the second offense.（2）＂Cumulative penalty for the second offense＂has supervision and correction effects on the subjects.The effects are affected by the penalty intensity,timeliness and execution conditions,as well as some social and economic factors.Conclusion（1）We should take branches of enterprises,beauty and traditional Chinese medicine industries as well as the southern part of this district as the focuses of health supervision and strengthen the supervision of middle-and-low-end business buildings＇cliniques without licenses.（2）We should improve the mechanism for connecting case implementation and penalty and strengthen the institutional researth on discretional administrative penalty,which should fully reflect the principle of ＂punishment fitting the offence＂.
