摘　　要：目前我国婚姻法结婚制度的主要任务,在于培育人们的婚姻理性,避免不完全信息与有限理性对婚姻合作均衡的破坏。夫妻关系制度应赋予婚姻主体在法定框架内自由设置夫妻权利义务清单的自由。而在离婚制度方面,应确立"婚姻期待利益严重损害"的诉讼离婚标准和"未成年子女最大利益保护原则",并建立无过错离婚的女方合理补偿机制。At present,the main task of our country＇s marriage law is to cultivate people＇s rationality on marriage,and avoid the destruction of cooperative equilibrium because of incomplete information and limited rationality.Conjugal relation system should give the marriage parties freedom of setting rights and obligations between husband and wife under legal framework.In divorce system,we should establish lawsuit divorce standard of ＂expectation interests seriously damage＂ and ＂minor children＇s maximum interest protection principle＂,and set up reasonable compensation mechanism for no-fault wife in divorce.
