摘　　要：腐败的历史性、世界性和顽固性决定了腐败成为21世纪各国普遍关注和亟待解决的问题。我国经历了运动反腐、权力反腐和制度反腐的实践,良好的制度建设已成为我国治理腐败的关键。但多而快的制度建设不一定能减少腐败,制度建设过程中存在的"制度缺陷"、"制度漏洞"和"制度软约束"反而可能导致制度性腐败。本文在提出制度性腐败概念的基础上,从制度设计、制度变迁和制度约束三个角度对制度性腐败产生的原因进行了深刻的剖析,并就如何对制度性腐败进行破解提供了一定的解答。Corruption exists historically and universally with the characteristic of refractoriness,which makes it to be an imperative problem in the 21st century.The anti-corruption practice in China adopted the methods of social movement,public power and institutional construction successively.At present,construction of a good system is the key factor of anti-corruption in China.However,lots of institution established rapidly do not necessarily reduce corruption,for deficiencies,loopholes and soft constraints existing in the system may lead to the birth of institutional corruption.Based on the concept of institutional corruption,the paper analyses its' origin from the perspective of institutional design,institutional change and institutional constraints,and puts forward convincing solutions to institutional corruption as well.
