论中国式违宪审查制度及其完善

摘　　要：基于中国特色或中国模式之独特性,中国所建构的"违宪审查"制度属于独立的违宪备案审查制度;非基本法律是且应当是违宪审查的对象,因此宜将法律纳入违宪审查的范围,并考虑逐步扩大之。宪法文本中的"不适当"含义包含着违宪的情形,建议全国人大常委会对此进行宪法解释。中国式违宪备案审查制度需要完善,并建议制定《违宪备案审查程序法》。Based on China＇s unique characteristics,its judiciary review system belongs to the independent judicial review filing system.The non-fundamental statues are and should be the subjects of the review;thus,it is reasonable to include statues within the domain of review.The meaning of ＇improper＇ in the Constitution incorporates the situation of inconsistency with Constitution,and so it is suggested that there should be a Constitution interpretation by the Standing Committee of the National People＇s Congress.China＇s filing system for judicial review should be improved and a ＂Procedure Law for Filing Judicial Review＂ should be implemented.
