论行政强制及其三个子概念之间的逻辑关系——优先基于语词逻辑的纯粹文义解析

摘　　要：行政强制及其三个子概念的划分,面临着尚未解决的学理疑问。采用纯粹文义解析的路径,重新审视学界共识中的行政强制及其三个子概念之间的逻辑关系可以发现:作为类概念的行政强制存在着子概念划分标准的混乱。为克服概念理解中存在的逻辑标准混乱,应当遵循修辞规范和逻辑常理,通过"达成类概念、子概念及其逻辑关系的基本共识;统一子概念的划分标准;选择恰当的标准内容;寻找合理的分界点;确定简洁明了的名称"五个步骤,重塑行政强制及其子概念的逻辑体系。The division of administrative enforcement and its three sub-concepts remain as an unsolved academic and theoretical question.By thinking on the logic relations between administrative enforcement and its three sub-concepts based on the literal meaning,it can be found that: there are confusions in the division of the class concept administrative enforcement and its sub-concepts.To get rid of these rhetorical and logical confusions,the rhetoric standard and logical thinking should be followed to rebuild the logical system between administrative enforcement and its sub-concepts through five procedures,namely,reaching basic consensus on class conception,sub-concepts and their logical relations,unifying the standard in dividing the sub-concepts,selecting proper standards,finding reasonable dividing point and identifying concise and clear names.
