摘　　要：在利用影响力受贿罪中,"关系密切的人"是指实际上影响并利用国家工作人员的职务之便,为请托人谋取不正当利益的人,不是指行为人与国家工作人员之间的实际关系"密切"。"关系密切的人"与受贿罪共犯中的"特定关系人"适用的场合不同,抽象地比较两者之间的关系没有意义。国家工作人员也可成为利用影响力受贿罪的主体。In the crime of bribery by influence, the man of close relations means the man who actually affects the national staff and obtains profiteering for the entrusting person, doesn＇t mean the relationship itself is close. The applicative situation of the man of close relations and the man of specific relations is different, so it is meaningless to compare their relationship abstractly. The national staff can also become the subject of the crime of bribery by influence.
