摘　　要：婚姻家庭领域的权利义务包括人身和财产两方面,夫妻双方都享有各自的权利,同时也承担相应的义务以保证对方权利的实现。然而现实生活中婚内侵权现象从未淡出过婚姻家庭领域,婚内侵权现象越来越危害家庭伦理和社会秩序。夫妻侵权责任制度具有保护当事人合法权益和填补受害人合法权益遭受损害的救济功能。英美法系和大陆法系法律都对此有明确规定。借鉴域外国家的相关制度,分析建立夫妻侵权责任制度的理论依据,探讨我国夫妻侵权责任制度构建的根基,为建立具有中国特色的夫妻侵权责任制度服务。The rights and obligations of marriage and family include both personal and property rights and obligations.Both spouses have their own rights,but they also undertake corresponding obligations to ensure the realization of the other＇s rights.In real life,violations within marriage had never been out areas of our marriage and family.More and more violations within marriage and family harm the social ethics and order.Marital tort liability system has the function to protect the rights and interests of the spouses and fill the relief function of legal rights of the victims suffered damage.Common laws and Continent laws have clearly stipulated on it.By learning the relevant systems in other countries,analyzing the theoretical basis of marital tort liability system,studying the construction of the couple tort liability system,the authors tried to serve for the establishment of the couple tort liability system with Chinese characteristics.
