人文主义视角下的中国古代监狱制度

摘　　要：人文主义是指崇尚人的价值、尊重人的本性的观点或思想体系。其最根本特征就是以人为中心,重视人的价值和尊严。其基本原则主要包括尊重人的需要和利益、防范人的恶性、宽容人的弱点、鼓励人的优点。中国封建社会正统的法律思想以重民恤狱为核心,古代监狱制度中长期实行的恤刑、悯囚、录囚等在不同程度上体现了上述基本原则,闪现着人文主义的光芒,是值得借鉴的传统资源。The most fundamental characteristics of humanism is human-centered,attention is paid to human values and dignity.The basic principles of humanism include： emphasizing human need and interests,guarding against human vice,tolerating human weakness and encouraging human merits.The orthodox legal thinking in Chinese feudal society laid stress on respect for the people and showed solicitude for the prisoners,and in practice these basic principles had been conformed to some degree.These are the traditional resources from which we can learn much.
