论医学临床实习与患者隐私权的保护

摘　　要：在医学临床教学活动中，医学生参加临床实习的权利和患者的隐私权之间经常发生冲突，从而导致一系列纠纷。本文从“患者隐私权”的界定和受法律保护的依据入手，探究权利冲突的产生原因，并提出以建立患者知情同意机制、补偿机制和设立教学医院三种方式来解决权利冲突的问题。In the teaching activities of the clinical medicine, there is often some conflict between the medical students＇ right to participate in clinical medicine practice and the patients right to protect their privacy, which results in series of disputes. From the definition of patients right of privacy and its legal basis, this paper explores the reasons of the conflicts, and puts forward three ways to solve the problem： consent mechanism, compensation mechanism and set up teaching hospitals.
