摘　　要：本文充分论述了全球化背景下对中药进行国际保护的重要性，在对目前我国中药的法律保护与行政保护现状及存在的专利保护因新颖性受限、商业秘密保护独占性缺陷、行政保护范围窄等问题进行分析的基础上，提出要由我国主导制定中药相关国际标准、倡导国际立法、增强中药国际保护意识等。结合我国中药的独特性，以全面有效保护中药为基本出发点，开辟一条全新的中药国际保护之路。This paper discusses fully the importance of international protection of Chinese medicine under the background of globalization. After analyzing the current situation of the legal protection and administrative protection of Chinese medicine in China, the existing patent protection for limited novelty, the defects for monopoly of trade secret protection, and the narrow range of administrative protection, this paper suggests that we should formulate relevant international standards for Chinese medicine, advocate international legislation, enhance the international protection consciousness of Chinese medicine, and open up a new way of international protection of Chinese medicine based on the full and effective protection for it.
