震后重建物权归属处理问题研究——以四川省北川县为例

摘　　要：震后重建物权归属处理是灾区重建过程面临的一个重要问题,处理不当极有可能引发新的社会矛盾,阻碍重建进程。本文以北川县为例,通过文献研究与实地调研,从所有权、用益物权、担保物权三个方面以及灾民对部分财产处理的评价对比分析,指出当前震后重建过程中物权归属处理所存在的问题,从国家所有权、一般物所有权、房屋所有权、土地承包经营权、房贷问题等方面,提出具有针对性的建议,旨在对震后重建工作提供参考。The problem of real right is an important issue in the reconstruction.New social conflicts may arise if this problem is not handled properly.Taking Beichuan County as an example,this paper uses field research and literature research to analyze the problem of real right during Wenchuan earthquake reconstruction from the ownership,usufruct,security interest and so on,and proposes some suggestions.
