摘　　要：受托人的谨慎投资义务是现代信托制度的核心内容之一,它是在历经三个阶段的演进中吸收了现代投资组合理论而形成的,并随着信托投资实践的发展,愈益受到重视,我国现行信托法律对受托人谨慎投资义务的设计存在欠缺,我们很有必要对之加以吸收和借鉴,在立法上确立基金管理人的谨慎投资义务,并使之清晰化与具体化。The prudent investment duty of the trustee is one of the core contents in modern trusteeship.Through the three developing stages,it was formed on the basis of Modern Portfolio Theory.With the practice of trust investment,it has attracted more and more attention.There is some deficiency regarding the trustee＇s prudent investment in the current trust law in China.Therefore,we should establish in legislation the prudent investment duty of the fund manager and make it clearer and more specific.
