摘　　要：我国现行知识产权审判模式即在法院内部设置知识产权庭审理知识产权案件存在诸多弊端,如影响知识产权案件审判效率、案件审理周期过长、法院审判标准不统一、割裂知识产权案件的整体性和统一性。我国应在借鉴美德日等国有关知识产权法院成功经验的基础上,结合自身国情和司法制度设立知识产权法院。具体做法是按知识产权案件密集程度建立一审法院,并设立知识产权上诉法院;在审级的选择上,宜以三级终审为最终模式;知识产权法院综合审理知识产权民事、行政和刑事案件。同时,因知识产权具有较强的技术性和专业性,对纯技术性内容的判断有赖于知识产权法院中技术专家制度的建立。There are many disadvantages in China＇s current IPR trial mode： the setting up and trialing the cases refers to the intellectual property rights in court,such as the influence on the trial efficiency related to the intellectual property rights,the long cycle of case,the disunity on the court trial,and the laceration of the unity and integrity in the cases that associated with the intellectual property rights.We should set up the intellectual property court bases on the successful experience of the related intellectual property court in America,German and Japan and so on according to its own national conditions and the judicial system.Specifically speaking,we should set up the first-instance court according to the intensity of the intellectual property case and establish the appeal court of the intellectual property,have the three-tiered final adjudication as the final structural model on the choice of the trial level,and make the intellectual property court trial intellectual property civil,administrative and criminal case Comprehensively.At the same time,there is a need to establish the technical experts system of the intellectual property to judge the pure technical content due to the strong technicality and profession of the intellectual property.
