摘 要:宏观调控的技术性、灵活性和转型时期宏观调控的试错性特点是制约宏观调控法治化的障碍。针对这些障碍,宏观调控法治化可以采取逐步推进的方式:一方面,要无条件地实现宏观调控的基本规则法定,建立宏观调控法律责任制度;另一方面,继续采取委任立法的方式,但要不断将法规转化为法律;继续保留法律的充分弹性,但要适时地将弹性立法转化为刚性立法。为了适应转型时期宏观调控创新、试错和地方实验的需要,要建立良性违法机制。Technology and flexibility of macro-control with the trial error of the macro-control in transition are barriers to the rule of law of macro-control.For these barriers,the rule of law of macro-control can employ step by step approach: on the one hand,we should achieve unconditional statutory in basic rules of macro-control and liability system.On the other hand,we should continue to take the legislated appointment,but to keep the regulations into law.We need to retain full flexibility in the law which will be flexible legislation into rigid legislation in a timely manner.In order to meet innovation and trial error and local experiment of macro-control in transition and character of experiment,we need to establish a positive mechanism.
